Terms of Use
Last updated
These Terms of Use ("Terms") are an agreement between you and PrepFriend ("PrepFriend", "we", "us") for www.prepfriend.com, app.prepfriend.com and any message you send us (together, the "Service"). By creating an account, using the Service or sending us a message you agree to the Terms. If you do not agree, do not use PrepFriend.
Beta service
PrepFriend is available to eligible users (13 and older) and is still in beta. Features, questions and reports may change, be unavailable or contain errors, and we may reset or remove beta features. Please tell us what is not working.
Who can use PrepFriend
PrepFriend is a test-prep service for students, parents and teachers. You must be at least 13 years old to use PrepFriend; we do not accept users under 13, and you confirm your age when you create an account. A parent or teacher who adds a student confirms the student is 13 or older. If you are 13 to 17, you may use PrepFriend only with the permission of a parent or guardian, who accepts these Terms on your behalf. If we learn that an account belongs to a child under 13, we will close it and delete its data, as described in the Privacy Policy. If you use PrepFriend for a school or class, you confirm you are authorised to do so.
Accounts
You create an account at app.prepfriend.com/register and sign in with a Google (Gmail) account. Give accurate information, keep your sign-in to yourself, and tell us promptly if you think someone else has used your account. You are responsible for what happens under your account. A parent who links a student to their account confirms they are that student's parent or guardian and that the student is 13 or older. We may refuse registration, or suspend or close an account that breaks these Terms or puts the Service or other users at risk. You can ask us to delete your account at any time; we do so within 30 days, as described in our Privacy Policy.
Messages you send us
When you use the contact form we receive your email address, the topic you choose and your message. We use them to reply to you. We do not sell this information. Our Privacy Policy explains what we collect and how to have it deleted. If you send us feedback or suggestions, you allow us to use them to improve the Service without obligation to you.
Acceptable use
Do not misuse PrepFriend. In particular, do not: attempt to break in, probe, overload or interfere with the Service; scrape or automatically collect content; share your account or access another person's account; copy questions, lessons or reports for redistribution or to build or train another product; enter unlawful, abusive or infringing material; or use the AI features for anything unlawful or harmful. Use the AI features for studying.
Our content
Questions, lessons, reports, software and the PrepFriend name and logo belong to PrepFriend or its licensors and are protected by law. We give you a personal, non-exclusive, non-transferable, revocable licence to use them for your own study, or with your own students or teenagers, in line with these Terms. You keep ownership of your own answers and messages, and you allow us to use them to run the Service and show your progress. No guarantee of results
PrepFriend helps you practise and shows where to focus, but we cannot promise any particular score, admission or other outcome. AI suggestions and explanations can be wrong; check anything important against official sources.
Disclaimer
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and we do not promise that it will be uninterrupted or without errors. Some places do not allow some of these exclusions, so they may not apply to you in full.
Limit of liability
To the fullest extent the law allows, PrepFriend and the people who run it are not liable for any indirect, incidental, special, consequential or punitive loss, or for lost data, profits or test results, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to US $100. Nothing in these Terms limits liability that cannot lawfully be limited, such as for fraud or for death or personal injury caused by negligence.
Your responsibility
If your breach of these Terms or your misuse of the Service leads a third party to bring a claim against PrepFriend, you will, to the extent the law allows, compensate us for the resulting loss and reasonable costs.
Ending your use
You may stop using PrepFriend at any time and ask us to delete your account, which we will process within 30 days as described in our Privacy Policy. We may suspend or end access if you break these Terms, if the law requires it, or if we stop offering the Service (in which case we will try to give notice). Sections that by their nature should continue, such as those on content, liability and governing law, continue after your account ends.
Governing law and disputes
These Terms, and any dispute arising from them or from the Service, are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict-of-law rules. Before starting any formal claim, please contact us and give us 30 days to try to resolve it informally. If we cannot, the state and federal courts located in California have exclusive jurisdiction and you and we consent to them, except that either of us may bring a claim in small-claims court where it qualifies. To the extent the law allows, claims must be brought individually and not as part of a class action. If you are a consumer outside the United States, this does not remove mandatory protections of your home country's law.
California users. Under California Civil Code section 1789.3, California users are entitled to the following notice: the Service is provided by PrepFriend (see the Legal Disclosure); to resolve a complaint or receive further information, contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
Changes
We may update these Terms as PrepFriend grows. The date at the top shows the latest version. For a significant change we will notify account holders by email or in the app before it takes effect; continuing to use PrepFriend after a change means you accept it. If a part of these Terms is found unenforceable, the rest stays in force, and our not enforcing a right is not a waiver of it.
